1. Introduction
Welcome to Convitly. These Terms and Conditions govern your access to and use of the Convitly website and platform (the “Service”), operated by Convitly (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Description of the Service
Convitly is a digital platform that allows users to create, customise, and share digital invitations. The Service includes a visual editor, hosting of published invitations, RSVP form integration, background music, multilingual support, and other features as described on our website.
3. Account Registration
To use certain features of the Service you must create an account. You agree to provide accurate and complete information during registration, to keep your account credentials secure, and to notify us immediately of any unauthorised access. You are responsible for all activity that occurs under your account.
4. Pricing and Payments
Convitly operates on a one-time payment model. Prices are displayed on our website and include applicable taxes unless otherwise stated. Payments are processed securely through third-party payment providers (e.g., Stripe). By completing a purchase, you authorise the applicable charge.
5. Refund Policy
Because the Service delivers a digital product that is immediately accessible after purchase, refunds are generally not provided once the invitation has been published. If you experience a technical issue that prevents you from using the Service, please contact us at hello@convitly.com and we will work to resolve the issue or, at our discretion, issue a refund.
6. User Content
You retain ownership of all content you upload to the Service (photos, text, music selections, etc.). By uploading content, you grant Convitly a limited, non-exclusive licence to host, display, and distribute that content solely for the purpose of operating the Service and delivering your invitation to your guests.
You represent and warrant that you own or have obtained the necessary rights and permissions for all content you upload, including any third-party intellectual property such as images or music.
7. Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload content that is defamatory, obscene, hateful, or infringes on the rights of third parties.
- Attempt to gain unauthorised access to the Service, other user accounts, or related systems.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service.
- Use automated tools (bots, scrapers, etc.) to access the Service without our prior written consent.
8. Intellectual Property
The Service, including its design, code, templates, logos, and branding, is owned by Convitly and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.
9. Availability and Modifications
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. Published invitations will remain accessible for a reasonable period as communicated at the time of purchase.
10. Limitation of Liability
To the maximum extent permitted by law, Convitly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or interruption of service. Our total liability shall not exceed the amount you paid for the Service.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (such as intellectual property, limitation of liability, and indemnification) will remain in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal.
13. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
